Terms and Conditions of Service

These Terms and Conditions of Service (hereinafter, the "Terms") constitute a legally binding agreement entered into by and between you (hereinafter, the "User") and QueCargan (hereinafter, "QueCargan" or the "Platform"), governing all access to or use of the website quecargan.com, its accounts, dashboards, reviews, community features and related services (collectively, the "Service").

By creating an account or operating a control that unequivocally manifests acceptance of these Terms, the User consents to these Terms and to the Privacy Policy. Ordinary browsing shall subject the User to these rules to the extent permitted by applicable law, without constituting, in and of itself, click-wrap acceptance or a handwritten signature. All express electronic acceptance shall be construed in accordance with applicable law, including Law No. 8454 on Certificates, Digital Signatures and Electronic Documents. If the User does not accept these Terms, the User shall refrain from creating any account and from using the interactive features of the Service.

Accounts are reserved for natural persons over eighteen (18) years of age, possessed of full legal capacity to contract. Use of the Service by an organization shall be effected through a duly authorized person accepting these Terms on its behalf.

QueCargan is an independent market information, research, comparison and community service focused on battery electric vehicles of relevance to the Republic of Costa Rica. QueCargan does not sell, import, finance, insure, warrant, inspect, deliver or broker vehicles, and receives no commission whatsoever contingent upon the consummation of any sale.

No relationship of agency, partnership, joint venture, employment, commission or representation exists between QueCargan and any seller, distributor, manufacturer, banking institution, insurer, repair shop, charging infrastructure operator or any other third party mentioned on the Service. Each third party shall be solely and exclusively responsible for its offers, inventory, prices, promotions, contracts, financing terms, warranties, representations and legal obligations.

The inclusion of any vehicle, price, seller, banking institution, insurer or hyperlink on the Service shall constitute no endorsement, certification, verification, recommendation or warranty on the part of QueCargan.

The User undertakes to furnish accurate, current and complete information; to preserve the confidentiality and security of their credentials and of any connected Google or Facebook account; and to notify QueCargan forthwith of any suspected unauthorized use. The User shall be responsible for all activity conducted under their account, save as otherwise provided by mandatory law.

The User shall not impersonate any natural or legal person, create deceptive or duplicate accounts, use the identity or email address of any third party, or transfer the account without the prior written consent of QueCargan. For the protection of the account and of the Service, QueCargan may, at any time, require reasonable verification of identity or ownership.

The User retains ownership of the reviews, comments, questions, answers, images, files and other content submitted (hereinafter, "User Content"). By submitting the same, the User represents and warrants that they hold the rights necessary to do so, that such content does not violate these Terms, the rights of any third party or applicable law, and that it does not unlawfully disclose the personal data of any third party.

The User grants QueCargan a non-exclusive, worldwide, royalty-free license — sublicensable solely to providers operating the Service — to host, store, reproduce, adapt, format, translate, publish, display, distribute and generally use User Content solely to the extent reasonably necessary to operate, secure, improve, explain and promote the Service. Said license shall terminate as to any given content upon its deletion by the User or upon deletion of the account, save for copies reasonably retained in backups, moderation records or records kept for the defense of claims.

QueCargan may, in its sole discretion and without prior notice, review, edit as to formatting, hide, unpublish or remove content, and restrict or terminate accounts, where it reasonably determines that these Terms are breached, that a security, privacy or legal risk exists, or that the integrity of the community or of the Service is at stake. Moderation constitutes a prerogative exercised in good faith and not an obligation to supervise every contribution, and shall in no event imply endorsement of published content.

Catalogue data, prices, range figures, specifications, images, financing references and other information displayed on the Service are sourced from distributors, manufacturers, sellers, public sources and QueCargan's own research, and are furnished strictly for reference purposes, "as is", without representation or warranty of any kind as to accuracy, completeness, timeliness or fitness for a particular purpose.

Prices, inventory, promotions, trims, equipment, software, warranties, charging speeds and specifications are subject to frequent change and may contain errors or omissions. Vehicle range is displayed on a CLTC basis; for trims lacking a published CLTC measurement, the displayed figure may be derived from another published test cycle and shall not constitute an official CLTC certification. Actual range will vary according to trim, battery condition, climate, terrain, speed, load and driving style.

Nothing on the Service shall constitute legal, financial, tax, mechanical, insurance or safety advice, nor any binding offer, quotation or commitment. Prior to making any decision or entering into any transaction, the User shall verify all material facts — including final price, charges, taxes, eligibility and contractual terms — directly with the relevant seller or provider.

The Service may contain hyperlinks or references to sellers, distributors, banking institutions, insurers, charging services, authentication providers and other third-party sites and services. Such services lie outside the control of QueCargan and operate under their own terms, prices, privacy policies and security practices. The User's dealings with any third party shall be deemed entered into exclusively between the User and such third party. QueCargan shall bear no liability for losses or damages arising from third-party content, products, services or conduct, and the existence of a hyperlink shall imply no endorsement, verification or liability whatsoever.

The QueCargan name and logo, the design of the Service, its source code, databases, compilations and editorial content, together with third-party marks displayed for merely identificatory purposes, are protected by copyright, intellectual property law and other applicable laws.

These Terms confer upon the User a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Service for lawful personal purposes or internal evaluation. No title or intellectual property right whatsoever is transferred, all rights not expressly granted being reserved to QueCargan.

To report a copyright or trademark infringement, write to hola@quecargan.com, furnishing information sufficient to identify the material and to evidence standing to act.

The User shall be solely responsible for User Content and for their use of the Service. To the maximum extent permitted by applicable law, the User undertakes to hold harmless and indemnify QueCargan, its operators and collaborators, against any and all claims, demands, losses or expenses (including reasonable attorneys' fees) arising out of User Content, breach of these Terms or violation of any law or third-party right. The foregoing indemnity shall not apply to the extent, and only to the extent, that the claim originates in willful misconduct attributable to QueCargan.

The User may cease using the Service and request deletion of their account at any time, in accordance with the procedure described on the Account and Data Deletion page. QueCargan may restrict, suspend or terminate access to all or part of the Service, with or without notice, where reasonably necessary to address a breach of these Terms, a security risk, abuse, fraud, a legal obligation or material harm to the Service, its users or third parties. Where circumstances so permit, QueCargan may afford notice and an opportunity to cure. Provisions which by their nature ought to endure shall survive termination, including, by way of illustration and not limitation, those concerning intellectual property, warranty disclaimers, limitation of liability, indemnity and governing law.

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, QueCargan disclaims all express or implied warranties, including those of merchantability, fitness for a particular purpose and non-infringement, and does not warrant uninterrupted operation, comprehensive coverage or error-free data, prices or user content.

To the maximum extent permitted by applicable law, QueCargan shall bear no liability for indirect, incidental, special, punitive or consequential damages, nor for lost profits, loss of revenue, data or goodwill, arising out of or relating to the Service, reliance upon catalogue data, third-party conduct or any transaction to which QueCargan is not a party. QueCargan's aggregate liability for all claims arising out of or relating to the Service shall not exceed fifty United States dollars (USD 50).

No provision of these Terms shall exclude, limit or constitute a waiver of liabilities or rights that the law does not permit to be excluded, limited or waived, including the rights recognized under Costa Rican consumer protection law (Law No. 7472 and amendments thereto), liability for willful misconduct or gross negligence, and the jurisdiction of competent regulators and courts. Any clause held abusive or ineffective by a competent authority or court shall apply solely to the extent permitted by mandatory law.

QueCargan shall bear no liability for delays or failures attributable to events beyond its reasonable control, including internet, hosting or provider outages, cyberattacks, strikes, natural events, epidemics or acts of authority. QueCargan may modify, suspend or discontinue any part of the Service at any time; such modifications shall constitute no breach and shall give rise to no liability, save as otherwise provided by mandatory law.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Costa Rica, without regard to conflict-of-laws rules. Any dispute shall first be addressed in good faith by written communication to hola@quecargan.com. Failing amicable resolution, the parties submit to the exclusive jurisdiction of the civil courts of the First Judicial Circuit of San José, Costa Rica, as special domicile, without prejudice to (i) the jurisdiction that consumer protection legislation and the National Consumer Commission retain over consumer relations, and (ii) any other forum whose exclusion is not legally possible.

QueCargan may revise these Terms at any time, the effective date indicated in the heading being updated accordingly; material changes may be announced on the Service or by email. Continued use of the Service following the effective date shall imply acceptance of the revised Terms as to subsequent use, save where mandatory law requires separate, express or demonstrable acceptance, or where QueCargan has undertaken to give prior notice.

Should any provision of these Terms be held unenforceable, it shall be applied to the maximum permissible extent and the remainder shall subsist. QueCargan's failure to enforce a breach shall constitute no waiver as to any other. These Terms, together with the Privacy Policy and the Cookies and Browser Storage Policy, constitute the entire agreement between the parties with respect to the Service and supersede all prior agreements on the subject matter. The User may not assign these Terms; QueCargan may assign them in connection with a transfer of the Service.
