Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and QueCargan ("QueCargan", "we", "us") governing every access to or use of the quecargan.com website, accounts, dashboards, reviews, community features, and related services (together, the "Service").

These Terms govern your use of the Service. By creating an account or selecting a control that clearly states that you accept these Terms, you agree to them and our Privacy Policy. Ordinary browsing makes these usage rules applicable to the extent permitted by law, but it is not itself a click-through acceptance or a handwritten signature. Any express electronic acceptance is interpreted under applicable law, including Ley N.° 8454 (Certificados, Firmas Digitales y Documentos Electrónicos). If you do not accept these Terms, do not create an account or use interactive features.

Accounts are reserved for natural persons who are at least eighteen (18) years old and legally capable of binding themselves. Use of the Service by an organization must occur through an authorized individual who accepts these Terms on its behalf.

QueCargan is an independent marketplace-information, research, comparison, and community service focused on battery-electric vehicles relevant to Costa Rica. QueCargan does not sell, import, finance, insure, warrant, inspect, deliver, or broker vehicles, and receives no commission contingent on any vehicle sale.

No agency, partnership, joint venture, employment, mandate, or representation relationship exists between QueCargan and any seller, distributor, manufacturer, bank, insurer, workshop, charging operator, or other third party named on the Service. Each such third party is solely and exclusively responsible for its own offers, inventory, prices, promotions, contracts, financing conditions, warranties, representations, and legal duties.

The inclusion of a vehicle, price, seller, lender, insurer, or link on the Service is not an endorsement, certification, verification, recommendation, or warranty by QueCargan.

You agree to provide accurate, current, and complete information, to keep your credentials and any connected Google or Facebook account secure, and to notify us promptly of any suspected unauthorized use. You are responsible for all activity carried out through your account, except where applicable law provides otherwise.

You may not impersonate any person or entity, create deceptive or duplicate accounts, use another person's identity or email address, or transfer your account to a third party without our prior written consent. To protect the account and the Service, we may request reasonable verification of identity or ownership at any time.

You retain ownership of the reviews, comments, questions, replies, images, files, and other content you submit ("Your Content"). By submitting it, you represent and warrant that you hold the rights required to do so and that it does not violate these Terms, third-party rights, or applicable law, and that it does not unlawfully disclose another person's personal data.

You grant QueCargan a non-exclusive, worldwide, royalty-free license — sub-licensable only to providers operating the Service — to host, store, reproduce, adapt, format, translate, publish, display, distribute, and otherwise use Your Content solely as reasonably necessary to operate, secure, improve, explain, and promote the Service. The license ends for specific content when you remove it or your account is deleted, except for copies reasonably retained in backups, moderation records, or records kept for the defense of legal claims.

We may, at our discretion and without prior notice, review, edit for format, hide, unpublish, or remove content, and restrict or terminate accounts, whenever we reasonably consider that these Terms are violated, that a safety, privacy, or legal risk exists, or that the integrity of the community or the Service is at stake. Moderation is a good-faith facility, not an obligation to supervise every contribution, and never implies endorsement of published content.

Catalog data, prices, ranges, specifications, images, financing references, and other information shown on the Service are compiled from distributors, manufacturers, sellers, public sources, and QueCargan's own research, and are provided for reference only, on an "as is" basis, without any representation or warranty of accuracy, completeness, timeliness, or fitness for a particular purpose.

Prices, inventory, promotions, trims, equipment, software, warranties, charging speeds, and specifications change frequently and may contain errors or omissions. Range varies with the homologation cycle (CLTC, WLTP, EPA, NEDC), trim, battery condition, weather, terrain, speed, load, and driving style; a "CLTC equivalent" figure is a derived estimate, not an official certification.

Nothing on the Service constitutes legal, financial, tax, mechanical, insurance, or safety advice, nor an offer, quotation, or binding commitment. Before making any decision or transaction, you must verify all material facts — including the final price, fees, taxes, eligibility, and contract terms — directly with the corresponding seller or provider.

The Service may contain links or references to sellers, distributors, banks, insurers, charging services, authentication providers, and other third-party websites and services. Those are outside our control and operate under their own terms, prices, privacy policies, and security practices. Your dealings with any third party are exclusively between you and that third party. QueCargan is not liable for any loss or damage arising from third-party content, products, services, or conduct, and a link does not imply endorsement, verification, or responsibility of any kind.

The QueCargan name and logo, the Service's design, source code, databases, compilations, and editorial content, together with third-party marks shown for identification purposes, are protected by copyright, trademark, and other applicable laws.

These Terms grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for lawful personal or internal evaluation purposes. No ownership or intellectual-property right is transferred to you, and all rights not expressly granted are reserved by QueCargan.

To report copyright or trademark infringement, write to hola@quecargan.com with information sufficient to identify the material and your authority to act.

You are solely responsible for Your Content and for your use of the Service. To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold QueCargan and its operators and collaborators harmless from and against any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from Your Content, your breach of these Terms, or your violation of any law or third-party right. This indemnity does not apply to the extent, and only to the extent, that the claim arises from QueCargan's own willful misconduct.

You may stop using the Service and request deletion of your account at any time as described on the Data Deletion page. QueCargan may restrict, suspend, or terminate access to all or part of the Service, with or without notice, when reasonably necessary to address a violation of these Terms, a security risk, abuse, fraud, a legal obligation, or material harm to the Service, its users, or third parties. Where circumstances permit, we may give notice and a chance to correct the issue. The provisions that by their nature must survive termination — intellectual property, disclaimers, limitation of liability, indemnity, and governing law, among others — survive.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, QueCargan disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant uninterrupted operation, complete coverage, or error-free data, prices, or user-contributed content.

To the maximum extent permitted by applicable law, QueCargan is not liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Service, reliance on catalog data, third-party conduct, or any transaction to which QueCargan is not a party. QueCargan's aggregate liability for all claims arising out of or related to the Service shall not exceed fifty United States dollars (USD 50).

Nothing in these Terms excludes, limits, or waives liability or rights that cannot lawfully be excluded, limited, or waived — including rights recognized by Costa Rica's consumer-protection legislation (Ley N.° 7472 and its reforms), liability for willful misconduct or gross negligence, and the authority of competent regulators and courts. Any provision declared abusive or inefficacious by a competent authority or court will be applied only to the extent permitted by mandatory law.

QueCargan is not liable for delays or failures in performance caused by events beyond its reasonable control, including failures of internet, hosting, or third-party providers, cyberattacks, strikes, natural events, epidemics, or governmental acts. We may modify, suspend, or discontinue any part of the Service at any time; such changes do not constitute a breach and create no liability except where the law provides otherwise.

These Terms are governed by and construed under the laws of the Republic of Costa Rica, without regard to conflict-of-laws rules. Any controversy shall first be addressed in good faith by writing to hola@quecargan.com. Failing amicable resolution, the parties submit to the exclusive jurisdiction of the civil courts of the First Judicial Circuit of San José, Costa Rica, as special elected domicile, without prejudice to (i) the jurisdiction that mandatory consumer-protection law and the Comisión Nacional del Consumidor retain over consumer relations, and (ii) any other competent forum that cannot lawfully be excluded.

We may revise these Terms at any time. The effective date shown above will be updated, and material changes may be announced on the Service or by email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms for subsequent use, except where mandatory law requires separate, express, or demonstrable acceptance, or where we have committed to give you prior notice.

If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permissible and the remainder stays in effect. Our failure to enforce any breach is not a waiver of any other breach. These Terms, together with the Privacy Policy and the Cookie and Browser Storage Policy, are the entire agreement between the parties concerning the Service and supersede prior agreements on that subject. You may not assign these Terms; QueCargan may assign them together with a transfer of the Service. Notices may be sent to the email linked to your account or published on the Service.
